Dear friends, family, and fellow chicken lovers,
We’re Mary and Craig Schroeder, and we need your help. For years, we’ve been locked in a grueling legal battle with our former HOA over something near and dear to our hearts: our pet chickens. What started as a personal fight to keep our feathered family members has grown into something much bigger—a case that could set a critical legal precedent for backyard chicken owners across the United States, especially here in North Carolina.

Even though we’ve since moved away from that neighborhood, the fight isn’t over. The HOA slapped us with $31,500 in fines, and our legal fees have soared to nearly $48,500—and they’re still climbing. This battle has drained our savings and tested our resolve, but we’re not giving up. Why? Because this isn’t just about us anymore—it’s about protecting the rights of countless others who cherish their backyard flocks.

On April 22, 2025, our case will be heard at the North Carolina Supreme Court. This is a make-or-break moment, not only for us but for anyone who believes in the freedom to raise chickens sustainably and responsibly in their own yards. A win could safeguard chicken owners from overreaching HOAs nationwide; a loss could embolden restrictive rules and fines for years to come.
We’ve poured everything we have into this fight, but we can’t do it alone. Legal battles are expensive, and every dollar counts as we prepare for this pivotal court date. That’s why we’re turning to you—our community, our supporters, and everyone who believes in standing up for what’s right.

NC Supreme Court Hears Case on Backyard Chickens

 

I've been following this case on the edge of my seat for some time now.  Let me catch you up.  


 

Mary and her husband Craig bought a home in a farm community that allowed horses and chickens, and yes, they confirmed that.  At some point, someone changed their mind, and started fining them.  Fines reached $31,500 before they finally gave up and moved away.  This case was won by the neighborhood HOA in court, but Mary and Craig won on appeal - Appellate Court.  Now it will be heard at the NC Supreme Court April 22 in Raleigh.  I will be there!

Let's take a look at the covenants.  

"A maximum of three horses may be kept and stabled on
any lot or combination of adjoining lots under common
ownership. . . . No other animals, livestock, or poultry of any
kind shall be raised, bred, or kept on any lot, except that
dogs, cats, or other household pets, may be kept provided
that they (including horses) are not kept, bred, or
maintained for any commercial purpose. No dog kennels of
any type shall be kept or maintained on the property."

The reason this case is so important is the fact that backyard chickens popularity have made them more pets than livestock or poultry.  Anyone familiar with pet chickens knows they are quite different that their counterparts in the poultry houses.  Let's hope the NC Supreme Court agrees.

Woman Fights HOA to Keep Pet Chickens and WINS! Video Chicken Live interview

 

Incredible story!  Mary Schroeder fought her HOA and won!  Hear her side of the story on Video Chicken Live as Matt and I interview her and have a bit of fun as usual.  

 

 

11 year old Carolina Coop gets rehomed and still looks like new!

One of the perks I've had working with Matt of Carolina Coops, is sometimes I'm the lucky beneficiary of a used coop.  By used, I mean like new because I swear these coops don't age. 

 

In 2017, I acquired a coop that was traded in for a different model -- a rare occurrence.  It was several years old, but looks brand new. 

Back then, egg hutches opened from the top.  We discovered that the hens are startled more that way, so after a design change, the egg hutches now open from the front. 

Carolina Coops also has changed the ramp to a ladder, which I like much better.  The ramp is still available by request.

 

 

By 2024, the coop was still good, just dusty and the roof was hit by a tree.   

 

My kid and I drove it to my brother and his wife in SC, where it is in it's 11th year, 4th move, and good as new!   They have already asked me to help them get some more chickens. 😁

During the 4 years or so doing a live chicken podcast, we've learned a lot and had fun doing it.  We've interviewed celebrities, hatcheries, feed companies, treat companies, a wildlife biologist, a composting/bsfl expert, poultry vets, an author, chicken door inventor, and so many more. 

The show is hosted by Matt (CEO of Carolina Coops) with me as the co-host.  Ingrid is the producer.  I like to bring in Cracker Muncher, just to stir things up.
